Power of Attorney
A power of attorney can be defined as a legal instrument authorizing someone to act as the grantors agent. This document can be drafted to be time restricted, job restricted or just a general power of attorney. Needless to say, a time bound power of attorney ends once the stipulated time is over and a job specific power of attorney is terminated once the specific job is completed.
One of various situations when a power of attorney becomes necessary is when a person becomes medically or mentally incapacitated. A medical power of attorney on the other hand takes effect when a patient looses the mental capacity to take decisions. Needless to say a medical power of attorney holds immense value and it is important that the person or firm entrusted with the responsibility is chosen with care.
An appropriate medical power of attorney form must be filled out to ensure that an individual or a law firm has the power to carry out your financial and medical matters incase you loose your mental capacity. A health care provider or community care operator (and relatives of these persons) cannot be appointed as bearers of a medical power of attorney. You can also create a living will along with a medical power of attorney. Specific questions pertaining to what you would like to do in case of a coma, vegetative state or a medically terminal condition are asked in a power of attorney form.
